IndianTrainSim (ITS)

1. Definitions

ITS / IndianTrainSim: IndianTrainSim.com, including its website, Windows application, administrators, owners, and operators.

Site: IndianTrainSim.com

ITS App: The official IndianTrainSim Windows Application.

User / Customer: Any individual accessing, browsing, purchasing, or using the Site or ITS App.

Creator / Seller: Independent third-party developers who publish content on the platform.

Content / Products: Digital add-ons, routes, scenarios, models, assets, or related materials made available through ITS.

2. Platform Role & Nature of Services

IndianTrainSim operates as a digital distribution platform and marketplace and may, in certain cases, also act as the creator and publisher of specific products offered under the ITS name.

ITS does not manufacture, author, certify, or guarantee any product unless explicitly stated.

Products may be published:

  • Under the ITS name, or

  • Under a third-party creator’s name, in which case the creator retains ownership.

ITS acts as a distributor and platform facilitator for third-party products.

Platform rules, enforcement systems, and license validation mechanisms apply to all products, regardless of ownership.

3. Pre-Purchase Disclosures & User Acknowledgements

3.1 Original Game Requirement

All products require a genuine Steam copy of Train Simulator Classic.
Pirated or modified versions are unsupported and may result in account termination.

3.2 No Affiliation With Indian Railways

IndianTrainSim has no affiliation, endorsement, sponsorship, or authorization from Indian Railways or any railway authority.

Names, liveries, locomotive classes, coach types, routes, or references are used solely for simulation realism and identification purposes.

No ownership, license, or commercial rights over Indian Railways trademarks or intellectual property are claimed or granted.

Such references shall not be construed as commercial use or exploitation of Indian Railways intellectual property.

4. Virtual & Simulated Nature of Content

All products available on IndianTrainSim are entirely virtual simulations.

Models, routes, physics, signaling, performance, sounds, and behavior are approximate representations only.

Content is not real, certified, official, operational, or authoritative.

Products must not be relied upon for:

  • Real-world railway operations

  • Training, safety, engineering, or decision-making

  • Professional or institutional use (unless separately approved in writing)

Any resemblance to real-world systems is illustrative only.

5. Accuracy, Marketing & No Guarantees

Product descriptions, screenshots, videos, promotional text, and marketing material are illustrative in nature.

ITS does not guarantee that:

  • Products are 100% accurate to real-world railways

  • Content fully matches marketing descriptions

  • Features shown will exist permanently or at all

Variations, omissions, simplifications, or inaccuracies may exist at any time.

Users acknowledge that marketing material does not constitute a warranty or promise.

6. Updates, Maintenance & Availability

IndianTrainSim and/or creators:

  • Do not guarantee future updates, upgrades, fixes, compatibility, or continued availability

  • May modify, suspend, replace, or discontinue any product or feature at any time, with or without notice

  • Are not obligated to maintain compatibility with future game versions, hardware, or operating systems

Lack of updates does not entitle users to refunds or compensation.

7. Purchase Terms

All sales are final and non-refundable, except where explicitly required by law.

Digital content is delivered exclusively via the ITS App.

Prices may change at any time without prior notice.

8. Licensing & Usage Reference

Use of products is governed by the End-User License Agreement (EULA).

The EULA prevails in case of any conflict regarding licensing or usage rights.

9. Commercial Use

Commercial, institutional, training, or simulator use is prohibited by default.

Such use is permitted only with prior written approval from ITS, subject to specific terms.

Approval may be:

  • Product-specific

  • User-specific

  • Organization-specific

Absence of written approval constitutes a violation.

10. Account Suspension & Enforcement

ITS reserves the right to:

  • Suspend or permanently ban accounts without notice

  • Revoke access to products

  • Disable downloads, reinstallation, or usage

  • Enforce anti-piracy and fraud controls

Violations include, but are not limited to:

  • Piracy or license bypass

  • Unauthorized redistribution

  • Misuse of commercial rights

  • Platform abuse

    Fraud, abuse, enforcement actions, appeals, and related consequences are governed by the Legal – Fraud, Abuse & Enforcement Policy, which forms an integral part of these Terms.

11. Third-Party Creators & Support

ITS does not guarantee third-party product quality, updates, or support.

Support responsibility rests with the respective creator unless otherwise stated.

ITS is not liable for creator actions, omissions, or decisions.

12. Disclaimer of Warranties

All services and products are provided “AS IS” and “AS AVAILABLE”.

ITS, its administrators, and creators expressly disclaim all warranties, including:

  • Accuracy

  • Fitness for purpose

  • Non-infringement

  • Continuous availability

  • Error-free operation

13. Limitation of Liability

To the maximum extent permitted by law:

IndianTrainSim, its administrators, owners, staff, and creators shall have NO LIABILITY WHATSOEVER.

This includes, without limitation:

  • Data loss

  • System or hardware damage

  • Business loss

  • Loss of profits

  • Indirect, incidental, or consequential damages

Use of the platform and products is entirely at the user’s own risk.

14. Data & Privacy

System data collection and processing are governed by the Privacy Policy.

By using the platform, users acknowledge and accept such processing in accordance with applicable laws, including India’s Digital Personal Data Protection Act, 2023.

15. Amendments

These Terms may be modified at any time without prior notice.

Continued use of the Site or ITS App constitutes acceptance of updated terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws applicable in Ahmedabad, India.

All disputes shall fall under the exclusive jurisdiction of courts located in Ahmedabad.
