IndianTrainSim (ITS)
This Legal Policy forms an integral part of the IndianTrainSim legal framework and is incorporated by reference into the Terms & Conditions, End-User License Agreement (EULA), and Privacy Policy.
By accessing or using the IndianTrainSim platform, website, or ITS App, users and creators agree to be bound by this Policy.
1. Purpose & Scope
This Policy defines IndianTrainSimβs authority, enforcement framework, and actions related to fraud, abuse, misuse, and violations of platform rules.
This Policy applies to:

All creators and sellers
-
All accounts, systems, devices, and identifiers interacting with IndianTrainSim
2. Fraud, Abuse & Misuse
IndianTrainSim (βITSβ) maintains a strict zero-tolerance policy toward fraud, abuse, misuse, and circumvention of platform rules.
Fraud or abuse includes, but is not limited to:

Use of pirated, cracked, or modified base games
-
License tampering, bypassing, reverse engineering, or circumvention
-
Unauthorized redistribution, resale, or account sharing
-
False purchase claims, chargeback abuse, or payment manipulation
-
Unauthorized commercial, institutional, or simulator use
-
Circumvention of platform, security, or usage limits
-
Use of third-party tools or methods to evade enforcement
-
Creator misconduct, including stolen content, misrepresentation, or malicious uploads
Fraud determination does not require criminal intent and may be based on reasonable evidence, technical indicators, behavioral analysis, or platform-level verification.
3. Platform Authority & Final Discretion
IndianTrainSim retains sole and absolute discretion to determine violations, interpret this Policy, and apply enforcement actions.
ITS is under no obligation to:

Continue providing service
-
Restore access
-
Justify or explain enforcement decisions
-
Provide internal logs, evidence, or detection details
Access to the ITS platform and Licensed Content is a privilege, not a right.
4. Monitoring, Detection & Evidence
ITS may use automated, manual, or hybrid systems to:

Monitor usage
-
Detect fraud or abuse
-
Enforce licensing and platform rules
ITS is not required to disclose:
-
Detection methods
-
Security mechanisms
-
Technical indicators
-
Internal thresholds or evidence
Failure to disclose such information does not affect the validity of enforcement actions.
5. Enforcement Actions
Upon detection or reasonable suspicion of fraud or abuse, ITS may, without prior notice and at its sole discretion, take one or more of the following actions:

Suspend or permanently terminate user or creator accounts

Revoke licenses and access to all or selected products
-
Disable downloads, reinstallation, updates, or activation
-
Apply platform-wide bans affecting all ITS services and products
-
Restrict or block access based on device, system, or technical identifiers
-
Remove, delist, or permanently disable creator products
-
Withhold, suspend, or permanently block creator payouts
-
Share limited information with payment processors or authorities where legally required
All enforcement actions may be taken without refund or compensation.
6. Appeals
Affected users or creators may submit one (1) appeal only through the official support channel.

Appeals are reviewed solely at ITSβs discretion
-
ITS is not obligated to provide explanations, evidence, or technical details
-
Decisions following appeal review are final and binding
No further appeals will be accepted.
7. Data Retention in Enforcement Cases
Where fraud, abuse, or enforcement action occurs, ITS may retain limited and proportionate data, including:

Technical identifiers
-
Device or system markers
-
Account and enforcement records
Such data may be retained even if account access is terminated, for the purposes of:

Preventing re-registration or repeat abuse
-
Enforcing bans and platform rules
-
Protecting creators, users, and platform integrity
-
Complying with legal or regulatory obligations
This retention is carried out in accordance with applicable data protection laws and does not constitute account restoration or service continuation.
8. Associated & Future Account Enforcement
ITS reserves the right to:

Enforce actions across associated, linked, or future accounts
-
Deny service to users attempting to evade bans or restrictions
-
Apply enforcement based on shared identifiers or behavioral patterns
Ban evasion or re-registration attempts constitute independent violations.
9. Creator-Specific Enforcement
Creators are subject to additional obligations, including:

Ownership and intellectual property accuracy
-
Honest representation of products
-
Compliance with platform rules and laws
ITS may take creator-specific actions including:
-
Product delisting or removal
-
Revenue withholding or forfeiture
-
Permanent creator account termination
Such actions may occur independently of user-side enforcement.
10. No Waiver & No Precedent
Failure by ITS to enforce any provision of this Policy at any time does not constitute a waiver of its rights.
Past enforcement decisions do not create precedent or obligation for future actions.
11. Legal & Payment Cooperation
ITS may cooperate with:

Payment processors
-
Financial institutions
-
Regulatory bodies
-
Law enforcement authorities
Limited data may be disclosed where legally required or necessary to address fraud, abuse, or legal obligations.
12. Policy Updates
This Legal Policy may be updated at any time without prior notice.
Continued use of the ITS platform constitutes acceptance of the updated Policy.
13. Legal Hierarchy
In case of conflict, the following order of precedence applies:

14. Severability
If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Governing Law & Jurisdiction
This Legal β Fraud, Abuse & Enforcement Policy shall be governed by and construed in accordance with the laws applicable in Ahmedabad, India.
Any disputes, claims, or proceedings arising out of or relating to this Policy, including enforcement actions, shall be subject to the exclusive jurisdiction of courts located in Ahmedabad, India.
