END-USER LICENSE AGREEMENT (EULA)

IndianTrainSim (ITS)

This End-User License Agreement (“EULA”) is a legally binding agreement between you (“User”, “You”) and IndianTrainSim (“ITS”, “We”, “Us”) governing the use of IndianTrainSim software, add-ons, routes, scenarios, assets, and related digital content (collectively, the “Licensed Content”).

By installing, accessing, downloading, or using the ITS App or any Licensed Content, you agree to be bound by this EULA. If you do not agree, do not install or use the Licensed Content.

1. License Grant

ITS grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Licensed Content strictly in accordance with this EULA.

This license is not a sale. No ownership rights are transferred to you.

2. Permitted Use

2.1 Personal Use

You may use the Licensed Content for personal, non-commercial purposes.

2.2 Streaming & Monetized Content

You are permitted to use the Licensed Content in:

  • YouTube videos

  • Livestreams

  • Recorded gameplay

  • Monetized streaming platforms

Provided such use does not violate this EULA or applicable laws.

2.3 Commercial Use (Restricted)

Commercial use—including but not limited to:

  • Training institutes

  • Simulation centers

  • Educational or institutional setups

  • Commercial simulators

is strictly prohibited unless expressly approved in advance in writing by ITS via official email.

Commercial approval may be granted:

  • Per user

  • Per organization

  • Per product

as explicitly stated in the approval communication.

3. License Limitations

Unless explicitly permitted in writing, you may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code

  • Modify, adapt, or create derivative works

  • Bypass, disable, or tamper with licensing or security mechanisms

  • Redistribute, resell, sublicense, or share Licensed Content

  • Use the Licensed Content on multiple systems simultaneously

Licensed Content is bound to one system.
Up to six (6) system transfers per year may be permitted.

4. Intellectual Property Ownership

Ownership of Licensed Content remains as follows:

  • Content published under ITS branding is owned by IndianTrainSim

  • Content published under a creator’s name remains the intellectual property of that creator

ITS acts as the authorized distributor.
All platform rules, enforcement mechanisms, and licensing conditions apply in addition to creator rights.

No rights are granted except those expressly stated in this EULA.

5. Updates, Changes & Availability

ITS may, at its sole discretion and without notice:

  • Automatically update Licensed Content

  • Modify, replace, suspend, or remove features or content

  • Change compatibility or system requirements

You acknowledge that Licensed Content may change or become unavailable at any time.

6. License Termination

This license terminates immediately and automatically, without prior notice, if:

  • You violate this EULA

  • Your account is suspended or permanently banned

  • You engage in piracy, fraud, or misuse

Upon termination:

  • All Licensed Content becomes unusable

  • Re-download, reinstallation, or reactivation is permanently blocked

  • No refunds are provided

7. Anti-Piracy & Enforcement

ITS employs automated systems to:

  • Validate licenses

  • Detect unauthorized usage

  • Prevent piracy and misuse

Circumventing these systems is a material breach of this EULA and may result in permanent enforcement actions.

8. Disclaimer of Warranties

Licensed Content is provided “AS IS” and “AS AVAILABLE”.

ITS makes no warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose

  • Performance or uptime

  • Compatibility with all systems

  • Continuous availability

Use is entirely at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, ITS SHALL HAVE ZERO LIABILITY WHATSOEVER.

ITS shall not be liable for:

  • Data loss

  • System or hardware damage

  • Business interruption

  • Loss of profits

  • Indirect, incidental, or consequential damages

You expressly agree that use of Licensed Content is entirely at your own risk.

10. Age & Eligibility Clarification

The Licensed Content and base simulation game are not age-restricted for use or gameplay.

However, users must be at least 18 years of age (or the age of legal majority in their jurisdiction) to purchase Licensed Content or enter into binding transactions with IndianTrainSim.

Users below this age may access or use free content only with the consent and supervision of a parent or legal guardian.

11. Governing Law & Jurisdiction

This EULA shall be governed by and construed in accordance with the laws applicable in Ahmedabad, India.

All disputes shall be subject to the exclusive jurisdiction of courts located in Ahmedabad.

12. Survival

The following sections survive termination:

  • Intellectual Property Ownership

  • Anti-Piracy & Enforcement

  • Disclaimer of Warranties

  • Limitation of Liability

  • Enforcement actions, platform bans, license revocation, appeals, and related data retention are governed by the Legal – Fraud, Abuse & Enforcement Policy.

  • Governing Law & Jurisdiction

13. Entire Agreement

This EULA constitutes the entire agreement regarding the Licensed Content and supersedes any prior agreements relating to licensing.
