• ITS: The abbreviated name for IndianTrainSim.com..

• Site: The website IndianTrainSim.com..

• ITS App: The IndianTrainSim.com Windows App available on the Site’s App Download page. This may also be referred to as our App or Windows App.

• User/Customer: Any individual accessing or purchasing products and services from the Site.

• User’s/Customer’s Computer System: The device or computer system used by the User/Customer.

• We/Our/Us: The Website Admin, Owner, Staff, or Creator (Seller).

2. Pre-Purchase Information

Before purchasing products or add-ons from the Site, please note the following:

• Original Game Requirement: Your copy of the game must be genuine and purchased through Steam. Our add-ons do not support pirated or cracked versions, and no support will be provided for such versions.

• No Affiliation with Indian Railways: We have no association or affiliation with Indian Railways.

• Virtual Nature of Content: All add-ons and routes are virtual. When real-world names are used, they are for entertainment purposes only. No actual startup or simulation services are provided.

• Commercial Use Prohibited: Commercial usage of our add-ons is strictly prohibited.

• Third-Party Seller Disclaimer: The Site provides a platform for third-party creators to sell their products. We are not responsible for third-party product updates, quality, or ongoing support. Users are advised to review the background of each creator before purchasing.

• Product Support: All support for products must be directed to the respective product owner during normal working hours. Requests submitted outside these hours may not receive immediate attention.

3. Purchase and Use

3.1 Eligibility and Finality of Purchase

• Age Requirement: Purchases are available only to individuals aged 18 or older. If you are a minor, parental or guardian consent is required to purchase, install, and use our products.

• Final Sales: Due to the digital nature of our products and downloadable content (DLC), all sales are final. No refunds will be provided for approved purchases.

• Exclusive Distribution: All add-ons are available exclusively through the ITS App. No standalone copies will be provided.

3.2 Violations and Account Suspension

• We reserve the right to permanently suspend or ban any user’s account if a violation of these Terms and Conditions is discovered.

• In the event that a minor makes a purchase without proper parental or guardian consent, the account may be permanently banned and no refunds will be issued.

4. System Requirements

Your computer system must meet the following recommended specifications for Train Simulator Classic as defined by Dovetails:

Note: Laptop, notebook, mobile, or low-power devices (including those with integrated graphics) may experience reduced performance and are not officially supported. Updates to chipset, graphics, and audio device drivers might be necessary. For more details, please refer to the Train Simulator Classic User Guide.

5. Purchase Verification and Anti-Piracy

• Right to Deny: We reserve the right to reject any purchase request and to deny access or ban accounts associated with piracy or related misconduct. If a purchase is not approved due to such issues, any payment made will be refunded within 7 working days. (Refunds are not applicable for purchases that have been approved.)

• Usage Licensing:

  • Add-ons may be installed and run on a single system only.

  • In the event of a system change, up to six transfers are permitted per year.

  • Add-ons, routes, and other assets are non-transferable.

  • Engaging in piracy or any activity that harms the ITS brand or its community—including fraudulent transactions or the unauthorized reselling of downloaded content—will result in a permanent ban. In such cases, data pertaining to these infractions may be shared with relevant platforms to protect our creators and users.

6. Support Services

• Scope of Support: Our support is limited to issues affecting the operational state of a product (e.g., installation problems, sound errors). We do not offer consultations on system security, third-party software troubleshooting, or other non-product-related issues.

• Support Channels:

  • DIY video solutions and tutorials may be provided for common issues.

  • Remote or additional support may incur extra charges.

  • Phone support is subject to available.

• User Responsibility: Post-support, users are responsible for ensuring that their systems remain secure.

7. Data Collection and Privacy

• System Data Collection: To deliver optimal service quality, the ITS App collects essential computer details (including brand, graphics card, RAM, HDD/SSD names, serial numbers, and IP address). Users must install and run the ITS App on their systems to complete a one-time security scan before purchasing any add-ons.

• Storage and Use: Once the scan is completed, the data is securely stored within your user profile on our server. The app may also periodically scan your Railworks directory to ensure that all installed add-ons, routes, scenarios, sounds, and textures are up to date and functioning properly.

• Internet Requirement: An active internet connection is required while you play. Offline login features may be introduced in the future.

• Data Usage Disclaimer: The ITS App collects only the data related to the Railworks game and our products. For additional details, please refer to our Privacy Policy.

8. Disclaimer

• File Integrity: Although we provide secure files via the ITS App, we do not guarantee protection against data loss, system failure, or hardware malfunctions. It is the user’s responsibility to safeguard their system using reputable antivirus software.

• Price Adjustments: Prices are subject to change at any time without prior notice.

• Liability: In cases of piracy, unauthorized resale, or other misuse of content downloaded from IndianTrainSim.com or affiliated creators, the offending user’s account may be permanently banned without refund.

9. Final Note

By using the Site and ITS App, purchasing our products, or downloading free add-ons, you acknowledge and agree to these Terms and Conditions. These Terms may be updated periodically without prior notice. All disputes arising from the use of our Site or products shall be resolved under the jurisdiction of Ahmedabad, India.
