Thank you for choosing IndianTrainSim. Before browsing, purchasing, or downloading, please review these Terms and Conditions carefully. They ensure transparency and set the guidelines for a secure and satisfying experience with our products.

1. Introduction

These Terms and Conditions govern your use of IndianTrainSim.com and our secure Windows application (hereafter “ITS App”). By accessing our website or using our ITS App, you agree to be bound by these terms. Please read them thoroughly before proceeding.

2. Purchase Prerequisites

2.1. Game Authenticity

• Original Game Requirement: All purchases require an original Steam copy of the game. Our add-ons are incompatible with pirated or cracked versions, and we do not provide support for unauthorized copies.

2.2. Age Requirement

• Minimum Age: You must be at least 18 years old to purchase our products. If you are a minor, you must have explicit consent from your legal guardian prior to making any purchase.

• Unauthorized Purchases: Purchases made by minors without guardian permission may result in permanent account suspension without a refund.

2.3. Finality of Purchase

• Sales: Once a purchase is completed, it is considered final. No refunds will be issued.

3. Delivery & Licensing

• Exclusive Distribution: All add-ons are delivered exclusively via the ITS App. Standalone copies or alternative formats are not available.

• Account Suspension: Non-compliance with these terms may lead to the permanent suspension of your user account.

To ensure optimal performance of Train Simulator Classic and our add-ons, your system must meet the following requirements as outlined by Dovetails:

• Scope of Support: Our support is limited to ensuring that products are in a working state. We do not provide ongoing consultation or technical support for system security, software configurations, or hardware issues.

• DIY Solutions: Prior to live support, users are encouraged to utilize our video tutorials and do-it-yourself (DIY) troubleshooting guides.

• User Responsibility: It remains your responsibility to secure your system following any support session.

6. Fair Usage and Limitations

• Single-System License: Our add-ons, routes, and assets are licensed for installation on one system only. A maximum of six system transfers is allowed per year, and simultaneous usage on multiple systems is prohibited.

• Prohibited Activities:

  • Piracy, manipulation, or any activities that may harm IndianTrainSim’s products, users, or brand reputation.

  • Creating fraudulent orders or attempting to resell our products in any form.

• Enforcement: Violation of these provisions may result in permanent account suspension. Additionally, data related to fraudulent activities may be shared with other relevant platforms to prevent further abuse.

7. Data Collection and Privacy

7.1. Data Collection

To provide a high-quality user experience and ensure product compatibility, the ITS App collects the following details from your system:

• Computer brand

• Graphics card specifications

• RAM capacity

• HDD/SSD names and serial numbers

• IP address

Note: You must install and run the ITS App at least once (while logged in) to complete the system scan required for purchasing.

7.2. Periodic Scans

We may periodically scan your Railworks directory to verify that all installed add-ons, routes, scenarios, sounds, and textures are current and functioning as intended.

7.3. Internet Connection

An active internet connection is required during gameplay. (An offline login feature may be introduced in the future.)

7.4. Additional Charges

Downloading add-ons may incur additional internet data charges as determined by your Internet Service Provider (ISP).

7.5. Privacy Commitment

Your privacy is essential to us. Our app collects only data pertinent to the Railworks game and its associated content, and all collected data is stored securely.

8. Disclaimer

• File Safety: We strive to provide secure download files via the ITS App. However, we cannot guarantee immunity from data loss, system, hardware, or device malfunctions.

• User Responsibility: You are advised to protect your system with reputable antivirus software. IndianTrainSim and its affiliates assume no liability for any loss or damage incurred.

• Account Bans: Engagement in piracy or unauthorized reselling of our content can result in immediate and permanent access restrictions, with no refunds provided.

9. Amendments

We reserve the right to update these Terms and Conditions and the related End-User License Agreement (EULA) periodically, without prior notice. Continued use of our website or ITS App constitutes acceptance of any changes.

10. Legal Jurisdiction

All disputes arising from or related to these Terms and Conditions shall be governed by and construed in accordance with the laws applicable in Ahmedabad. All legal proceedings shall be brought in the courts located in Ahmedabad.
